These Terms and Conditions constitute the agreement between You and Art Tours by Artists Inc. Please read this information carefully. If you have any questions please call (917) 747 6565 (U.S).

EVENT:
ENGLAND, JUNE 15th-23rd, 2004

TO HOLD YOUR RESERVATION:
Complete the Booking Form on the application page, print out the Application Form and mail it to
Art Tours by Artists Inc.

A deposit of US$400 per person is required to reserve a place on the tour. Click here for Application Page
Final payment will be due 60 days before departure, i.e. Friday, April 15.

YOUR TOUR INCLUDES:
Seven (7) days workshop tuition.
Eight (8) nights hotel: Rates are per person, based on double occupancy with private bath
Eight (8) breakfasts
Seven (7) lunches
Two (2) evening meals
Coach transfer to the Cotswolds,
Excursions to painting sites in Richmond, London, the Cotswolds
All entrance fees.

NOT INCLUDED:
Airfare
Transfer from airport to hotel at start of course
Hotel before and after the tour
Airport taxes and customs fees
Health, accident, insurance for trip cancellation, and baggage loss (all insurance is strongly recommended)
Five (5) dinners
All drinks including alcohol
Tips to drivers & tour guides
Personal items such as laundry, passports, or purchases.

TOUR PRICE:
Rates are in U.S. dollars.
Rates are per person, double occupancy and are subject to change only due to currency fluctuations with or without notice.
Prices are based on currency exchange rates as of NOVEMBER 2003. Should any increase in the tour price be unacceptable to the passenger, a full refund of monies paid will be made.

AMENDMENTS:
Changes to travel arrangements made after booking (such as room assignment) made at the request of the tour participant will incur an amendment fee of US$20 for each change. Check payment is required.

CANCELLATION POLICY:
Cancellations received in writing before sixty (60) days from the date of departure will result in a full refund.
Cancellations received thirty-one (31) to fifty-nine (59) days before departure will result in a US$400 (four hundred dollars) per person cancellation fee.
Cancellations received within thirty (30) days or less before departure will result in forfeiture of the entire cost of the trip, i.e. no refund will be made.
If however, in the event the tour can be resold, a refund, equal to the resale value of the space, will be made after deduction of the $400 administrative fee. No refund will be given for non appearance.

Note:
Bookings are automatically cancelled if full payment and the signed application form are not received by Art Tours by Artists Inc., (PO Box 287213, New York NY 10128 ) thirty (30) days prior to departure. Penalties as per Cancellation Policy will be applied.

LATE BOOKINGS:
Reservations made within 60 days of departure require immediate full payment.

OVERNIGHT DELIVERY CHARGES:
These will be assessed when it is required to send documents by express mail.

CANCELLATION BY Art Tours by Artists, Inc.:
Art Tours by Artists Inc., reserves the right to cancel any trip. Events beyond our control, such as war, infectious diseases, overbooking by the hotels, prolonged severe weather, incapacity of tour leaders, etc., may occur. In such an event Art Tours by Artists Inc., will notify participants and if feasible offer an alternative. If the participant declines the alternative or none is available, Art Tours by Artists Inc., sole obligation is to refund all monies paid.

CANCELLATION/ TRAVEL INSURANCE:
The purpose of insurance is twofold: to cover you should something unforeseen happen to you (e.g. broken limb, death in the family, medical problem) and to cover your costs should the tour be cancelled. Insurance is therefore highly recommended to cover tour members

MINIMUM TOUR NUMBERS:
The tour has been priced on the basis of a minimum number of participants. In the event that fewer than the required number of participants have confirmed their bookings 60 days from date of commencement, Art Tours by Artists Inc., reserve the right to cancel the tour, giving a full refund of monies paid or, offer arrangements to proceed with the tour at a modified price.

ACCOMMODATIONS:
If you wish to have a ROOMMATE but don't know another person on the tour, we will do our best to assign a roommate of the same sex. However, if this is not possible you must be prepared to pay the single supplement. Obviously, we cannot be responsible for compatibility.

SMOKING:
For the comfort and safety of all participants, smoking is not permitted inside the studios or coaches.

AGE LIMIT:
All participants must be at least 18 years or older.

PHOTOGRAPHY ON TOURS:
Art Tours by Artists Inc., reserves the right to take both still and film or video pictures during the tour and to use such pictures for promotional and advertising purposes. The participant herby permits Art Tours by Artists Inc., to use such pictures without any payment due to the participant. The participant must notify Art Tours by Artists Inc., in writing that he/she does not grant Art Tours by Artists Inc., permission to use such pictures.

WEATHER:
England is sometimes subject to unusual weather conditions such as prolonged rain or flooding. In such a case, Art Tours by Artists Inc., reserves the right to modify the route or itinerary.

MEDICAL:
Art Tours by Artists Inc., can not be responsible for the loss, replacement, or scheduling of your medication. In the event that you become ill or are injured, Art Tours by Artists Inc., is not responsible for arranging medical care or arranging for your return to your home. No monies will be refunded if you choose to leave the tour early for whatever reason.

SUPPLIES:
Art Tours by Artists Inc., is not responsible for the supplying or replacement of painting and drawing equipment or easel.  (Participants will please bring their own easels; we are unable to provide them.)

SHIPPING:
DO NOT ship items unless you don't mind paying taxes and you are willing to risk having your goods delayed at customs If you can't carry it, please don't bring it. We cannot be responsible for the shipping of any items or taxes incurred. We will be making a trip to the art store on the first day if you need supplies.

RESPONSIBILITY:
Art Tours by Artists Inc., does not operate or own the restaurants or catering on the trip. Nor does it own or operate hotels, land transportation mechanisms, or any other person which is to provide goods or services for your trip. Art Tours by Artists Inc., only act as an agent for contractors providing services and cannot accept responsibility in whole or in part for any delays, delayed departures or arrivals, missed carrier connections, accidents, death, loss, damage, or injury to persons or property.

Art Tours by Artists Inc., does not assume liability whatsoever for any person or property due to an act of negligence or default by any hotel, carrier, caterer, restaurant, company, or person rendering any services included in the tour, or by act of God.
Further, no responsibilities are accepted for any damage or delay due to sickness, pilferage, labour disputes, machinery breakdown, quarantine, government restraints, weather, civil unrest, war, or other causes beyond Art Tours by Artists Inc., control. No responsibility is accepted for any additional expense, omissions, delays, rerouting, or acts of any government or authority.
Baggage and personal property are at owner's risk throughout the tour.

The right is reserved by Art Tours by Artists Inc., to
a) alter the itinerary or arrangements in the event it becomes necessary or advisable

b) substitute a teacher only in the event of emergency or to continue with the tour as planned without a teacher and a refund issued to the equivalent of the tuition

c) refuse to accept or retain as a member of a tour any person at any time.

By purchasing this tour, the participant acknowledges and accepts these conditions.
This Agreement shall be deemed transacted in the State of New York.

Any inquiries, claims or general complaints by the participant relating to the services provided by Art Tours by Artists Inc., must be submitted in writing to Art Tours by Artists Inc.,(PO BOX 287213 New York, NY 10128, USA) WITHIN thirty (30) days of the completion of the tour, and must contain conclusive evidence and detailed information.

ARBITRATION:
Any controversy or claim arising out of or relating to this Agreement, to your trip or to any material disseminated by Art Tours by Artists Inc., concerning your trip including, without limitation, any claim related to illness, injury, delay, property damage, inconvenience, or death shall be settled solely and exclusively by binding arbitration in New York City, New York, in accordance with the then current rules of the American Arbitration Association. Any such arbitration will be governed by substantive New York law.

This agreement and contract supersedes and cancels all prior communications and agreements whether written, oral, or implied. No provision in this agreement can be modified except upon in writing, signed by an officer of Art Tours by Artists Inc.,
